Legally, a person&#8217;s right to control hisor her body is<br \/>\nsacrosanct, and forcing medical care on an unwillingpatient is akin<br \/>\nto battery. Although patients do not have theright to demand<br \/>\ninterventions that are clearly futile, physiciansdo not have the<br \/>\nright to impose interventions, even if medicallyindicated, contrary<br \/>\nto the patient&#8217;s wishes. The legal historyestablishing a competent<br \/>\npatient&#8217;s right to refuse medical interventionshas been well<br \/>\ndocumented elsewhere <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R2-10\">[2]<\/a>.<br \/>\nAlthough we appreciatethe concern that Ms. Hansot&#8217;s physicians<br \/>\nshowed for the preservationof life, the actions of these physicians<br \/>\nviolated the patient&#8217;sright to decide for herself what quality of<br \/>\nlife was acceptable<a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R1-10\">[1]<\/a>.<br \/>\nThe hospital was legally required to ascertain whetherMs. Hansot had<br \/>\ncompleted an advance directive or similar documentbut failed to do<br \/>\nso. Then, the physicians put a tube down thepatient&#8217;s throat,<br \/>\nconnected her to a mechanical ventilator,and placed her in physical<br \/>\nrestraints so that she could notemancipate herself. Despite clear<br \/>\nevidence from the patientand the patient&#8217;s legally designated agent<br \/>\nthat Ms. Hansot didnot want her life prolonged in this manner, it<br \/>\ntook 5 days forthe physicians to relent and bring their<br \/>\ninterventions intoaccord with the patient&#8217;s desires. That these<br \/>\nphysicians actedwith the best of intentions makes Ms. Hansot&#8217;s<br \/>\nexperience noless painful.<\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">Withholding and withdrawing life support from patients has gained<sup><br \/>\n<\/sup>widespread acceptance in the medical community <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R3-10\">[3,4]<\/a><br \/>\nand thelegal system <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R2-10\">[2]<\/a>,<br \/>\nbut we still see far too many patients tryingdesperately to cut<br \/>\nshort the process of dying, only to havetheir best efforts rebuffed<br \/>\nby physicians. This unwanted medicineis an arrogant usurpation of<br \/>\npatients&#8217; rights and serves neitherthe interests of the patient nor<br \/>\nthose of medicine as a profession.In ancient Greece, the Hippocratic<br \/>\nCorpus stated that one ofthe primary roles of medicine was to<br \/>\nrefrain from treating hopelesslyill persons, lest physicians be<br \/>\nthought of as charlatans <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R5-10\">[5]<\/a>.<sup><br \/>\n<\/sup>This caveat still applies today.<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">One of the major ways that patients exercise their autonomyis<br \/>\nthrough consent. Physicians have an ethical and legal responsibility<sup><br \/>\n<\/sup>to ensure that the patient has consented to the treatment they<sup><br \/>\n<\/sup>are providing. This involves talking to the patient. For hospitalized<sup><br \/>\n<\/sup>patients, physicians should determine, at a minimum, whether<sup><br \/>\n<\/sup>the patients wish to be designated as<br \/>\ndo-not-resuscitate\/do-not-intubateand whether the patients have<br \/>\nprovided an advance directiveor durable power of attorney for health<br \/>\ncare. When patientscannot speak (because of intubation, for<br \/>\nexample), they maybe able to communicate by nodding and shaking<br \/>\ntheir heads. Ifa physician believes that meaningful communication is<br \/>\nimpossible,a patient&#8217;s agent, designated by a durable power of<br \/>\nattorneyfor health care, can speak and decide for the patient. Dr.<br \/>\nHansot&#8217;sperception that her mother&#8217;s physicians did not concern<br \/>\nthemselveswith the wishes of their patient is disturbing.<sup><br \/>\n<\/sup><br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">In an emergency, patients who are not designated as<br \/>\ndo-not-resuscitate\/do-not-intubateare presumed to have given consent<br \/>\nfor cardiopulmonary resuscitation.However, once a patient&#8217;s<br \/>\ncondition has stabilized, consentfor continuing treatment is<br \/>\nmandatory. Admittedly, obtainingmeaningful consent from critically<br \/>\nill, ventilator-dependentpatients presents a difficult challenge and<br \/>\nis often made impossibleby the patient&#8217;s mental state. Patients<br \/>\nreceiving mechanicalventilation often appear to become depressed<br \/>\nand, if not heavilysedated, may become desperate in their desire to<br \/>\nbe extubated.Acutely ill, ventilator-dependent patients in intensive<br \/>\ncareunits regularly demand to be extubated despite having an<br \/>\nexcellentchance of returning to an independent life. Assessing the<br \/>\ncompetencyof these patients is critical because, although physicians<br \/>\nhaveno right to force unwanted care on patients, allowing a<br \/>\npatientin an altered mental state to make grave medical decisions<br \/>\ncanclearly be wrong. In such circumstances, carefully<br \/>\nevaluatingthe patient&#8217;s mental status, consulting with the patient&#8217;s<br \/>\nfamilyand loved ones, and waiting to see whether the patient&#8217;s<br \/>\nwishesremain stable over time can all help physicians determine<br \/>\nwhethera patient&#8217;s requests are consistent with the patient&#8217;s<br \/>\nknownvalues and goals. Such an assessment is generally easier<br \/>\ntomake when the physician has had a long-term relationship with<sup><br \/>\n<\/sup>the patient.<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">For Ms. Hansot, the best-case scenario was not a return to her<sup><br \/>\n<\/sup>former state but rather was a hemiparetic life in a nursing<sup><br \/>\n<\/sup>home. The physicians not only lacked Ms. Hansot&#8217;s consent but<sup><br \/>\n<\/sup>had evidence, supplied by her legally designated agent, that<sup><br \/>\n<\/sup>she did not want to live the life for which they were saving<sup><br \/>\n<\/sup>her. Good<br \/>\ncommunication skills make patients feelless lost in the hospital<br \/>\nenvironment and more cared for bytheir physicians. Effective<br \/>\ncommunication is particularly importantin the intensive care unit,<br \/>\nwhich is an alien environment forpatients and their loved ones. It<br \/>\nis filled with monitors andunfamiliar sounds, and the patients are<br \/>\noften obscured by asea of wires and tubing. Visitors may find<br \/>\nthemselves overwhelmednot only by the gravity of the patient&#8217;s<br \/>\nmalady but also bythe foreign stimuli. If the patient&#8217;s loved ones<br \/>\nmust make life-and-deathdecisions on the patient&#8217;s behalf, they will<br \/>\nprobably have feelingsof grief, guilt, and confusion. Caring<br \/>\nphysicians who take thetime to make emotional, human contact with<br \/>\npatients and theirfamilies can greatly ease the burden that these<br \/>\npersons feelat times of crisis <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R3-10\">[3,6]<\/a>.<sup><br \/>\n<\/sup><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">Reading Dr. Hansot&#8217;s account of her mother&#8217;s last days of life,we<br \/>\nask ourselves what happened to the humanistic aspect of medicinein<br \/>\nthis case. One of the roles of physicians is to give solaceand<br \/>\nsupport to patients&#8217; families during times of serious illness.That<br \/>\nthe pulmonologist accused Dr. Hansot of being an ageistpreoccupied<br \/>\nwith abstract principles when she was trying torealize her mother&#8217;s<br \/>\nwishes is to us a double violation of theprinciple of<br \/>\nnonmaleficence: The physician not only did harmto the patient by<br \/>\nprolonging her suffering but did harm to thepatient&#8217;s daughter by<br \/>\ngratuitously insulting her and causingher anguish. We believe that<br \/>\nmuch of Dr. Hansot&#8217;s and Ms. Hansot&#8217;sdistress could have been<br \/>\navoided if the physicians had madea greater effort to listen to<br \/>\ntheir patient and her daughter.<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">As Dr. Hansot implies, their is a difference between takingcare<br \/>\nof a patient and simply maintaining a patient&#8217;s vital signs.<sup><br \/>\n<\/sup>Providing emotional support, understanding, and empathy are<sup><br \/>\n<\/sup>important aspects of medical care. The recent,large, multicenter SUPPORT<br \/>\n(Study to Understand Prognoses andPreferences for Outcomes and Risks<br \/>\nof Treatments) trial <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R7-10\">[7]<\/a><sup><br \/>\n<\/sup>found that physicians largely ignored or were unaware of the<sup><br \/>\n<\/sup>desire of terminally ill patients to be designated as<br \/>\ndo-not-resuscitate\/do-not-intubate.And although poor communication<br \/>\nis a problem in itself, it isalso a symptom of deeper problems in<br \/>\nthe culture and climateof hospital-based medicine that must be<br \/>\naddressed. Indeed, thesecond phase of the SUPPORT study found that<br \/>\nhaving nurses facilitatecommunication between physicians and<br \/>\npatients improved neitherphysicians&#8217; awareness of patients&#8217; wishes<br \/>\nabout medical carenor the incidence or timing of written<br \/>\ndo-not-resuscitate orders.The deeper problems are related to<br \/>\nphysicians&#8217; attitudes towardlife and death and toward medical<br \/>\ninterventions and technology.Physicians&#8217; daily work with advanced<br \/>\nmedical technology mayengender a familiarity that makes it difficult<br \/>\nfor them to understandwhy patients often view ventilators and<br \/>\nfeeding tubes with anxietyand aversion. Similarly, medicine&#8217;s focus<br \/>\non pathology and physiology,on vital signs and diagnostic tests, may<br \/>\nobscure the human contextof the illness. Correcting electrolyte<br \/>\nimbalances may seem tobe more urgent than discovering what the<br \/>\npatient wants. Thisis especially true in the critical care setting,<br \/>\nin which thepatient may be intubated and sedated and in which the<br \/>\nphysician-patientrelationship may be reduced to a daily 2-minute<br \/>\nphysical examination.This elevation of the science of medicine above<br \/>\nthe humanityof the patient is a serious problem that probably cannot<br \/>\nberesolved without changes in the organization and culture of<sup><br \/>\n<\/sup>the hospital and the active support of hospital leaders <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R8-10\">[8]<\/a>.<sup><br \/>\n<\/sup><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">The problem of poor communication also reflects ongoing ambivalence<sup><br \/>\n<\/sup>and uncertainties about power and control in the physician-patient<sup><br \/>\n<\/sup>relationship. As the physician has gradually taken on a less<sup><br \/>\n<\/sup>paternalistic role in Western medicine, more emphasis has been<sup><br \/>\n<\/sup>placed on patient autonomy. This shift in emphasis has moved<sup><br \/>\n<\/sup>the balance of power in the direction of the patient. Educating<sup><br \/>\n<\/sup>patients about their diseases and available therapeutic options<sup><br \/>\n<\/sup>empowers them to participate more fully in medical decision<sup><br \/>\n<\/sup>making, but it also may threaten the physician&#8217;s sense of authority.<sup><br \/>\n<\/sup>Physicians may feel that they, with their greater medical knowledge<sup><br \/>\n<\/sup>and experience, are in a better position to make decisions about<sup><br \/>\n<\/sup>health care. Moreover, when it comes to difficult decisions<sup><br \/>\n<\/sup>about end-of-life care, physicians may believe that they can<sup><br \/>\n<\/sup>relieve the patient&#8217;s family of guilt, regret, and confusionby<br \/>\nmaking tough choices on their own. However, treatment decisionsare<br \/>\ninfluenced not only by outcome probabilities but also byphysicians&#8217;<br \/>\npersonal values and priorities <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R9-10\">[9-11]<\/a>.<br \/>\nBecause itis the patient&#8217;s life that is at stake, we believe that<br \/>\nthepatient&#8217;s voice must be heard and the patient&#8217;s values must<sup><br \/>\n<\/sup>be honored.<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">The case of Ms. Hansot raises an additional question about power:<sup><br \/>\n<\/sup>Was the physicians&#8217; disregard for their patient&#8217;s wishes influenced<sup><br \/>\n<\/sup>by the fact that Ms. Hansot and her daughter were women? We<sup><br \/>\n<\/sup>will never know the answer, but it is an important questionto<br \/>\nask. In the legal world, for example, a study of appellatecourt<br \/>\ndecisions in right-to-die cases found that the courtsconsistently<br \/>\nportrayed female patients as less capable of rationaldecision making<br \/>\nthan male patients <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R12-10\">[12]<\/a>.<br \/>\nAnd the issue is notjust that men devalue women&#8217;s voices; it is much<br \/>\nmore complicated.Feminist psychologists have observed that women are<br \/>\noften moreinterested in the truths of relationships than in the<br \/>\ndictatesof abstract principles, in the knowledge derived from<br \/>\nhumanconnections rather than the knowledge derived from<br \/>\nimpersonalreasoning <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R13-10\">[13,14]<\/a>.<br \/>\nWhen Dr. Hansot confronted her mother&#8217;s physicians,a series of power<br \/>\ndynamics were put into play. Dr. Hansot wasa non-medical person<br \/>\nquestioning medical professionals; shewas a woman questioning men;<br \/>\nand she was posing the facts ofher relationship with her mother<br \/>\nagainst the facts of medicinepresented by the physicians. The<br \/>\npulmonologist accused Dr. Hansotof preoccupation with abstract<br \/>\nprinciples, but it seems to usthat just the opposite was true. It<br \/>\nwas the pulmonologist himselfwho was preoccupied with the general<br \/>\nmedical principle thatlife is good and death is bad. Dr. Hansot was<br \/>\npreoccupied withthe knowledge of her mother&#8217;s wishes, which she had<br \/>\nobtainedthrough a close, lifelong relationship. We are arguing not<br \/>\nthatone perspective is superior to the other but that the power<sup><br \/>\n<\/sup>differential in the physician-patient relationship can represent<sup><br \/>\n<\/sup>a deeper problem that impedes communication and interferes with<sup><br \/>\n<\/sup>optimal medical care. If Dr. Hansot&#8217;s sex, her nonphysician<sup><br \/>\n<\/sup>status, and her focus on her mother&#8217;s wishes rather than onher<br \/>\nmother&#8217;s physiology combined to make it difficult for thephysicians<br \/>\nto listen to her, then we can only recommend thatphysicians practice<br \/>\ntaking off their white coats. To understandand empathize with those<br \/>\nwho are sick or dying, we physiciansmust learn to talk to patients<br \/>\nand families as regular personsand must avoid raising the barrier of<br \/>\nmedical authority. Physicians maybe uncomfortable<br \/>\nwith their own mortality and hence may avoidspending much time with<br \/>\ndying patients. Moreover, having beentrained to prolong life and<br \/>\novercome disease, they may feellike failures when they allow a<br \/>\npatient to die if that patient&#8217;slife could have been prolonged with<br \/>\nlife support. In this regard,withholding or withdrawing<br \/>\nlife-sustaining care can be one ofthe most difficult actions that a<br \/>\nphysician has to take. Physicianswho feel that they are unable to<br \/>\ntake such action probably shouldnot work in critical care.<sup><br \/>\n<\/sup><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">Discomfort with death may also explain one of the more disturbing<sup><br \/>\n<\/sup>aspects of Ms. Hansot&#8217;s case: the feelings of abandonment experienced<sup><br \/>\n<\/sup>by the patient and her daughter. Why did the physician of record<sup><br \/>\n<\/sup>leave it to Dr. Hansot to determine that it was indeed possible<sup><br \/>\n<\/sup>to communicate with the intubated patient? Why were none ofMs.<br \/>\nHansot&#8217;s physicians present at the time of death? Thereis an<br \/>\nunfortunate tendency in hospitals to avoid engaging thehumanity of<br \/>\ncritically ill patients near the end of life. Thefocus of<br \/>\nintensive-care-unit rounds can quickly turn from thepatient to the<br \/>\nflow sheet of vital signs and laboratory values.When this happens,<br \/>\nthe patient is denied some of the most importantbenefits that<br \/>\nmedicine has to offer, and the physicians aredenied one of their<br \/>\nmost meaningful roles, that of bedside caregiver.<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">Finally, physicians may fear the legal ramifications of withholding<sup><br \/>\n<\/sup>or withdrawing life support. These ramifications are complicated<sup><br \/>\n<\/sup>and still evolving, and they vary from state to state; we cannot<sup><br \/>\n<\/sup>explore them in detail in this context. What is clear is that<sup><br \/>\n<\/sup>physicians have no legal right to provide health care contrary<sup><br \/>\n<\/sup>to the wishes of the legally competent patient. In the specific<sup><br \/>\n<\/sup>area of cardiopulmonary resuscitation, case law indicates that<sup><br \/>\n<\/sup>physicians face greater liability when they provide futile<br \/>\nresuscitationthan when they withhold resuscitation <a href=\"http:\/\/208.34.222.225\/bin\/rdas.dll\/RDAS_SVR=www.annals.org\/cgi\/content\/full\/125\/2\/137#R15-10\">[15,16]<\/a>.<br \/>\nWithholding orwithdrawing care from incompetent patients contrary to<br \/>\nthe wishesof the family is a more complicated area that is beyond<br \/>\nthescope of this discussion. It was not so long ago<br \/>\nthat physicians accepted tendingto and comforting the dying as one<br \/>\nof their responsibilities.Even with all of our advanced technology<br \/>\ntoday, a good deathis sometimes the best we can offer. Sadly, modern<br \/>\nmedicine frequentlydoes the opposite, denying patients a peaceful<br \/>\nand dignifiedexit from this world.<\/p>\n<p><span style=\"font-family: verdana,arial,helvetica;\"><span style=\"font-family: verdana,arial,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\"><span style=\"font-family: arial,verdana,helvetica,sans-serif;\">Dr. Hansot&#8217;s account of her interactions with her mother&#8217;s pulmonologist<sup><br \/>\n<\/sup>suggests problems encountered all too often in medicine: Itis<br \/>\neasier to keep patients alive on ventilators than to grapplewith<br \/>\nwithdrawing support, and it is easier to define successin terms of<br \/>\nlife and death than to try to determine the qualityof life that is<br \/>\nmeaningful to an individual patient. To thephysicians attending Ms.<br \/>\nHansot, sending a hemiparetic patientwith a tracheostoma out of the<br \/>\nhospital to live in a nursinghome counted as success. Ms. Hansot,<br \/>\nhowever, had indicatedthat she wanted to be allowed to die.
